Introduction
1.1 These Terms and Conditions ("T&Cs") govern the relationship between WedAwai Ltd. ("we", "us", or "our"), registered at 124 City Road, London, EC1V 2NX, United Kingdom (Company Registration Number: 15978018), and any person or entity ("you" or "your") using our services to find and book wedding venues.
1.2 By using our services, you agree to these T&Cs. If you do not agree, please refrain from using our services.
1.3 Terminology:
Package: A combination of wedding planner, venue hire, and in some cases additional suppliers
Wedding Planner: A person or agency operating as a business at the wedding location, including wedding day coordination services.
Booking Agency: Agency services provided by WedAwai Ltd. offering a package.
The Price: The cost displayed on the WedAwai Ltd. website and included in the couple’s contract. This includes agency fees, venue sourcing, package customisation, pricing negotiation, payment handling, and ensuring a seamless booking process.
Clients: You, or any person or entity engaging our agency services for venue hire.
How Our Service Works
2.1 WedAwai Ltd. acts as a booking agent on behalf of the clients, arranging a package that includes the venue(s), wedding planner, and, in some cases, additional wedding suppliers.
2.2 WedAwai Ltd. processes deposit payments related to the package, including: Venue and planners’ fees. Exchange rate adjustments. Payment processing fees. Booking fee.
2.3 Final pricing reflects the confirmed number of wedding guests and is communicated by the Planners or/and wedding venue directly to the couple
2.4 By engaging WedAwai’s Ltd. services, the couple authorises WedAwai Ltd. to act as their agent to negotiate, book, and finalise contracts with venues and planners as part of the wedding package.
2.5 All bookings and contracts are subject to WedAwai’s Ltd. T&Cs and governed by the agreed package price.
2.6 While the clients’ contractual relationship with the venue and wedding planner is facilitated by WedAwai Ltd., clients are not always required to sign separate agreements with venues or planners.
However, in some cases, due to contractual complexities, clients may need to sign agreements directly with the venue and wedding planner.
Key terms from third-party agreements are incorporated into WedAwai Ltd.'s T&Cs to ensure transparency and a seamless booking experience.
While WedAwai Ltd. facilitates the contract between the client, the venue, and the wedding planner, WedAwai Ltd. does not assume liability for the venue’s and wedding planner’s obligations, performance, or any contractual breaches.
3. WedAwai Ltd. Website
3.1 We source information from wedding venues and wedding planners and strive to ensure accuracy. While we take reasonable care when adding new packages to our website, we cannot guarantee all information is error-free. Should errors arise, we will correct them promptly upon becoming aware. In addition, we review the information at least once a year.
3.2 The website and all our communications are in English as the primary language.
4. Services
4.1 We act solely as a booking agency for wedding venues, wedding planners, and in some cases additional suppliers in Europe. Our role is to assist clients in finding and securing suitable wedding venue (s), wedding planners, and in some cases, additional suppliers.
4.2 We do not own, operate, or control the wedding venues. The agreement for venue hire is directly between the client and the venue. WedAwai Ltd. facilitates the booking process by signing agreements with venues on behalf of the client, ensuring a seamless booking experience.
However, in some cases, due to the contractual complexities of the venue's agreement, clients may need to sign directly with the venue and planners. WedAwai Ltd. will provide these contracts in a timely manner.
4.3 Additional services and suppliers, above what is included in the package, may be recommended by the venue or wedding planner. (for example, photographer, makeup artist, etc.)
Payments for such services can be made directly to the suppliers or facilitated by the wedding planner, at client’s discretion.
5.Booking Process
5.1 Upon receiving an enquiry via online chat, email, or scheduled call, we will provide a selection of venues matching clients’ requirements.
Couple can visit and view the venue with the Planners prior to the booking, this is an extra charge to cover the Planners costs. WedAwai Ltd. will provide the relevant costings.
5.2 Once client selects a venue, complete our date request form. We will request the wedding date on their behalf.
5.3 A Deposit payment can be made via the bank transfer or an invoice including card payment option
5.4 The booking is confirmed only when the venue, or planner confirms availability in writing to WedAwai Ltd., clients pay the required non-refundable deposit and sign the required Terms & Conditions.
5.5 Wedding Date Confirmation
The wedding date is only confirmed once the venue or the wedding planner confirms it to WedAwai Ltd. in writing.
5.6 In the event that the selected wedding date is lost due to international money transfer delays, WedAwai Ltd. will offer either a full refund or an alternative available date, subject to written agreement with the clients. This is the only exception to the non-refundable deposit policy
5.7 Prices displayed on our website may change without notice. Final prices are communicated before booking confirmation.
6. Change of the wedding date and Cancellation
A request to change or cancel the wedding date must be submitted in writing to hello@wedawai.com.
Change of wedding date or cancellation form must be signed by clients (both parties).
6.1 Wedding Date Change Clause:
An admin fee of £300 applies for postponements.
Wedding date changes are subject to venue, and wedding planner availability. WedAwai Ltd. will endeavour to accommodate new dates but cannot guarantee availability.
6.2 Cancellation Clause:
Deposits are non-refundable.
If cancellation occurs by Clients:
More than 6 months before the wedding date: No charges beyond the deposit.
6 months or less: 80% of the total cost is non-refundable.
2 months or less: 100% of the total cost is non-refundable and due immediately.
6.3 An invoice will be issued for any outstanding balance due in the event of a cancellation, or for any difference in the package cost if the wedding date is changed, where applicable.
6.4 Cancelation by WedAwai Ltd: WedAwai Ltd. reserves the right to cancel the booking if payments are not made by the due date specified in the client's Terms and Conditions.
7.Fees and Commission
7.1 Our service fee is included in the total booking fee (deposit), visible on the WedAwai Ltd. website.
7.2 The booking fee (deposit) is non-refundable.
7.3 Prices include our commission, VAT, excluding local accommodation taxes.
7.4 Venue pricing is negotiated by WedAwai Ltd. and may differ from prices offered directly by the venue to other parties.
8.Payment Terms, Exchange Rates, Refunds
8.1 Deposit Processing
WedAwai Ltd. facilitates the payment of deposits for venue and planner reservations.
The remaining balance for the wedding must be paid directly to the venue and/or wedding planners as per their payment terms.
In some cases, due to contractual complexities, deposits may need to be paid directly to the venue and planner separately. WedAwai Ltd. will provide clear guidance on payment instructions based on the selected venue and services.
Likewise, in certain cases, contracts may need to be signed directly with the venue and wedding planner due to their contractual requirements. WedAwai Ltd. Will provide these contracts to the couple in timely manner.
8.2 Final Payments
Final payments, including any additional extras, must be made directly to the venue or planner, depending on their contractual terms.
Clients are responsible for adhering to the individual payment schedules set by the venue and planner to avoid cancellations or penalties.
8.3 Exchange Rates
We use fixed exchange rates as of January 2025. Currency fluctuations beyond a 2% threshold may impact final costs.
If an adjustment is required due to currency changes, clients will be notified in advance.
8.4 Refunds
WedAwai Ltd. acts solely as a booking agent and is not responsible for the venues or the wedding planner’s performance or any disputes arising after booking confirmation. Any requests for refunds or compensation related to venue services and/or wedding planners’ services must be addressed directly with the venue and/or the wedding planner.
9.Financial Protection
9.1 WedAwai Ltd. is a UK-registered company, ensuring compliance with local laws and financial safeguards.
9.2 Client payments are processed securely and transferred directly to the respective venue and planner. WedAwai Ltd. does not hold client funds in a separate escrow account
9.3 We recommend that clients secure additional wedding and travel insurance for further protection.
10.Liability
10.1 We act solely as intermediaries and are not liable for venue performance or wedding planners’ performance. As a responsible business, we perform due diligence to verify venues, planners, and suppliers before entering into contracts with them. While we act solely as intermediaries and are not liable for venue performance or quality, we strive to ensure we partner with reliable and reputable providers.
10.2 Our liability is limited to the booking fee paid to us, which is up to 10% of the Package cost.
11.Force Majeure
11.1 Neither WedAwai Ltd. nor the venues or wedding planners are liable for failure to meet obligations due to events beyond reasonable control, such as natural disasters, pandemics, or governmental restrictions.
12.Legal Paperwork and Travel Requirements
12.1 Ensuring valid documentation for travel and legal marriage is clients’ responsibility. Symbolic ceremonies may simplify legal complexities.
13.Photography Usage Rights
13.1 By using our services, you consent to WedAwai Ltd. using wedding photos and videos for promotional purposes unless you notify us in writing otherwise.
14.Complaints
14.1 For complaints, contact us via email at hello@wedawai.com. We aim to resolve issues within 14 business days.
15.Governing Law
15.1 These T&Cs are governed by the laws of England and Wales. Disputes are subject to their jurisdiction. Before pursuing legal action, both parties agree to attempt resolution through good faith discussions or mediation.
16. GDPR Compliance
16.1 WedAwai Ltd. complies with the General Data Protection Regulation (GDPR). Any personal data provided by clients will be handled securely and used solely for the purpose of delivering our services.
16.2 We will not share your personal information with third parties without your explicit consent, except as necessary to fulfil our contractual obligations.
